404 after bye on SIP trunk

I have a customer with SIP trunks via an MBG to a 3300 which mostly works fine, however we are getting an issue on outbound calls where if the called party hangs up first the sip peer sends a bye correctly but the MBG sends a 404 not found back to the peer, and does not pass the cleardown back to the MCD. As a result the call doesn't clear and if left open on the set, rtp streams from other calls start getting sent to that set.

I've checked the packet trace and the from and to headers seem to match between the invite and the bye, also the call id seems to match so I'm struggling to understand why the MBG does not clear the call and rejects the bye.

Is there anything I can change to try to force the issue?

what version on mcd?
there is a known issue with 6 sp1

dont know this issue specifically

MCD is 6.0SP3, MBG is 8.0.26.0
