Mitel 5340IP Phone and 3300MXE error L2 DL

Hello all!!! First time poster here. here is the situation: we purchased some refurbished phones and this one doesn't seem to update properly. I am not sure what the cause is. When registering the phone it starts to download from the TFTP gets to 1484 and then throws an error L2 DL and resets the phone. I did notice that this phone on start up shows MiVoice and I have not seen that before.  I have already tried setting the phone to defaults but the same error occurs. Went from offsite to on premise of the controller and the same error occurs. I am sure you will need more info than what was given but I am not sure what else to give you. Any help is appreciated.

I wonder if it's trying to download firmware older than what's already on it. What version is your 3300 using?
