MiVoice Office 250/Mitel 5000 / Time not working

My Mitel 5224 SIP phones are defaulting to 01/01/1970. My .cfg file has the SNTP server set to my local win2k8 server and the timezone set correctly too:
sntp= 172.27.100.1
time_zone= 10
If I jump on the handsets network config web page it shows it's leased the correct SNTP server address and the +10 time offset. From I workstation (in the same subnet as the phone) I can also test SNTP and get a response from my server just fine.

Any ideas on what cause is?

I have 5220 and 5224 handsets connecting to a cloud based hosted VoIP PBX. The phones boot fine and generally work fine however once a week or two phones will generate the error: Assert@121 #0r-13 rtos_mutex.cpp

The handset then requires a reboot to get it going again. It happens randomly to all handsets at any moment. The virtual PBX host requires us to use firmware version 4.00.00.13 for the phones so they are all at that version level.

Can anyone offer some information on what this error means and how I can fix it? Is it a firmware bug?
